    Mapp v. Ohio (1961) Holding:  Illegally obtained material cannot be used in a criminal trial. 4th amendment allows us to be secure with our property,  secure from unreasonable searches and seizures of property w/o due process like search warrants. 

    Miranda v. Arizona (1966)Holding: Police must inform suspects of their rights before questioning. = 5th Amendment a person in criminal case cant be forced to be a witness (spek) against himself.

    These cases protect the right of the accused AND force states to enforce the Bill of Rights in all legal matters such as  arrests, searches, right to a lawyer and not be a witness against your self.  These famous cases were desided by the "Warren Court" which expanded an individual's Bill of Rights' protections. Read about the Warren court and what it meant for civil liberties.

    Ulysses S. Grant became president and there were several political scandals that shook the nation. Name 2 scandals and one economic collapse. How did American citizens feel/ respond to these corrupt and inept issues?

    2. Whiskey Ring –

    Who was Booker T Washington?  On September 18, 1895, African-American spokesman and leader Booker T. Washington spoke before a predominantly white audience at the Cotton States and International Exposition in Atlanta. Known as the Atlanta Compromise Speech. What did he believe was the future for black workers in his “Atlanta Compromise” (speech)? It became one of the most important and influential speeches in American history. Then and now. Although the organizers of the exposition worried that “public sentiment was not prepared for such an advanced step,” they decided that inviting a black speaker would impress Northern visitors with the evidence of racial progress in the South. Why did many people then and now accuse Washington of being a sell out to black America? Also why did many people especially white southerners see his was the only way for black and white America to live in harmony?

    Plessy v Ferguson 1896: What was this Supreme Court case about and what did the SC decide?



    Slaughterhouse Court Cases: were a legal dispute that resulted in a landmark U.S. Supreme Court decision in 1873 limiting the protection of the privileges and immunities clause of the Fourteenth Amendment to the U.S. Constitution. In 1869 the Louisiana state legislature granted a monopoly of the New Orleans slaughtering business to a single corporation. Other slaughterhouses brought suit, contending that the monopoly abridged their privileges and immunities as U.S. citizens and deprived them of property without due process of law. When the suit reached the Supreme Court in 1873, it presented the first test of the Fourteenth Amendment, a Reconstruction measure ratified in 1868. By a five-to-four majority, the Court ruled against the other slaughterhouses. Associate Justice Samuel F. Miller for the majority, declared that the Fourteenth Amendment had “one pervading purpose”: protection of the newly emancipated blacks. The amendment did not, however, shift control over all civil rights from the states to the federal government. States still retained legal jurisdiction over their citizens, and federal protection of civil rights did not extend to the property rights of businessmen.

    Dissenting (opposing view) justices held that the Fourteenth Amendment protected all U.S. citizens from state violations of US citizens Bill of Rights—the privileges and immunities and that state impairment of property rights was a violation of due process.

    The Slaughterhouse Cases represented a temporary reversal in the trend toward centralization of power in the federal government. More importantly, in limiting the protection of the privileges and immunities clause of the 14th Amendment, the SC court unwittingly weakened the power of the Fourteenth Amendment to protect the civil rights of blacks. Many states began to see a difference between FEDERAL RIGHTS as in the BILL of Rights and the rights that a State viewed their residents people should have. This was like a 2 tier system-Yes you are protected from the Government by the constitution but not the state you live in. By 1876 only South Carolina, Florida, and Louisiana remained under Republican control. The outcome of that year’s presidential contest between Republican Rutherford B. Hayes and Democrat Samuel J. Tilden hinged on disputed returns from these states. Negotiations between Southern political leaders and representatives of Hayes produced a bargain: Hayes would recognize Democratic control of the remaining Southern states, and Democrats would not block the certification of his election by Congress Hayes was inaugurated; federal troops returned to their barracks; and as an era when the federal government accepted the responsibility for protecting the rights of the former slaves, Reconstruction came to an end. By the turn of the century, a new racial system had been put in place in the South, resting on the disenfranchisement of black voters, a rigid system of racial segregation, the relegation of African Americans to low-wage agricultural and domestic employment, and legal and extralegal violence to punish those who challenged the new order. Nonetheless, while flagrantly violated, the Reconstruction amendments remained in the Constitution, sleeping giants, as Charles Sumner called them, to be awakened by subsequent generations who sought to redeem the promise of genuine freedom for the descendants of slavery. Not until the 1960s, in the civil rights movement, sometimes called the “second Reconstruction,” would the country again attempt to fulfill the political and social agenda of Reconstruction.

    Constitutional Definitions

    Land Ordinance Act of 1787—Congress enacts the Northwest Ordinance, structuring settlement of the Northwest Territory and creating a policy for the addition of new states to the nation. The members of Congress knew that if their new confederation were to survive intact, it had to resolve the states’ competing claims to western territory.

    Shays Rebellion-helped Congress adopt a new Constitution that created a strong Federal government that in times of rebellion could send Federal troops in the state where rebellion was taking place.

    Constitutional Convention- May 25, 1787 the AOC were weak and a stronger federal govt. was needed. Shays rebellion convinced the 2nd Continental congress that govt needed more powers to crush rebellion in a state. The document would not become binding until it was ratified by nine of the 13 states. On September 25, 1789, the first Congress of the United States adopted 12 amendments to the U.S. Constitution–the Bill of Rights–and sent them to the states for ratification. Ten of these amendments were ratified in 1791. In November 1789, North Carolina became the 12th state to ratify the U.S. Constitution. Rhode Island, which opposed federal control of currency and was critical of compromise on the issue of slavery, resisted ratifying the Constitution until the U.S. government threatened to sever commercial relations with the state. On May 29, 1790, Rhode Island voted by two votes to ratify the document, and the last of the original 13 colonies joined the United States. Today the U.S. Constitution is the oldest written national constitution in operation in the world

     Albany Plan of Union- 1754 the Albany Plan was the first important proposal to conceive of the colonies as a collective whole united under one government. If failed.

    The Great Compromise (Roger Shermans Plan) The Great Compromise saved the Constitutional Convention, and, probably, the Union. Authored by Connecticut delegate Roger Sherman, it called for proportional representation in the House of Representatives and one representative per state in the Senate this was later changed to two Senators for each State in the Senate. Senators would be elected by their State assemblies until the passage of the 17th Amendment allowing for direct election of Senators.

    1--The Hoover Administration set the tone for an isolationist foreign policy with the Hawley-Smoot Tariff. Why?

    2--During the 1930s, the combination of the Great Depression and the memory of tragic losses in World War I contributed to pushing American public opinion and policy toward isolationism.
